Conditions for the Use of Vacation Certificates

Introduction:

These terms and conditions (hereinafter, the “Terms”) govern the use of vacation certificates issued by Flamingo Travel Club (hereinafter, the “Company”) to companies, institutions, or civil associations (hereinafter, the “Institutions”) for the benefit of their employees, clients, or community members (hereinafter, the “Beneficiaries”). These vacation certificates allow Beneficiaries to access travel experiences in specific destinations.

Available Destinations:

Vacation certificates grant Beneficiaries the option to choose from the following destinations:

3 days in Orlando, Florida

3 days in Miami, Florida

3 days in Las Vegas, Nevada

Certificate Activation:

To use the vacation certificate, the Beneficiary must activate it through a one-time, non-refundable payment within 10 days of receiving it from the Institution or the Company. This payment must be made following the instructions provided by the Company.

Coverage:

Each vacation certificate covers accommodations for up to 4 people. The Beneficiary is responsible for any additional expenses, such as flights, meals, and activities not included in the lodging package.

Mandatory Presentation:

The Beneficiary and their family, as certificate holders, agree to attend a brief informational presentation hosted by the hotel, lasting no more than 75 minutes. Failure to attend will result in an additional $400 charge to the card provided during certificate activation.

Usage Period:

Vacation certificates are valid for 12 months from the date of activation. The Beneficiary must schedule and complete the trip within this period. Certificates are non-transferable, non-refundable, and non-extendable after expiration.

Non-Commercial Use:

Vacation certificates provided to Institutions are strictly for use by Beneficiaries and may not be sold, marketed, or transferred to third parties. Any attempt to commercialize a certificate will result in its immediate cancellation and potential legal action.

Modifications and Cancellations:

The Company reserves the right to modify destinations or certificate details with prior notice to the Institutions. In the event of cancellation by the Company, the activation fee paid by the Beneficiary will be refunded.

Limitation of Liability:

The Company is not responsible for services provided by third parties such as airlines, hotels, or other travel service providers. Any disputes or issues related to those services must be addressed directly with the provider.

Arbitration Agreement:

Any dispute or controversy related to these Terms shall be resolved through arbitration in accordance with the rules of [Name of Arbitration Institution]. The arbitrator’s decision shall be final and binding on both parties.

Liability Waiver:

Beneficiaries acknowledge and agree that neither the Company nor its affiliates, employees, directors, or agents shall be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, personal injury, or death arising from the use or inability to use the vacation certificates, even if the Company has been advised of the possibility of such damages.

Governing Law and Jurisdiction:

These Terms shall be governed by and interpreted in accordance with the laws of the United States of America. Any legal action related to these Terms shall be brought exclusively in the courts of the State of Florida.

These Terms and Conditions constitute a legally binding agreement between the Company, the Institutions, and the Beneficiaries. By activating the vacation certificate, the Beneficiaries agree to fully comply with these Terms.
